Cross-border transactions are becoming increasingly common for medium-sized companies. With foreign business partners, hedging through written international contracts generally appears to be advisable. Contracts with companies in the USA or Great Britain represent a particular challenge. These countries have a fundamentally different legal system than mainland Europe. In Germany and continental Europe, basic legal rules derive from statutory law. Contracts merely shape the legal framework thus created. In the USA and Great Britain, the legal situation is practically only determined by the content of the contract.
